1. Purpose
This Acceptable Use Policy (“AUP”) defines the rules and acceptable standards for using CYBORA’s services, systems, platforms, and AI-assisted solutions.
The purpose of this AUP is to protect CYBORA, its clients, users, and third parties from misuse, abuse, or unlawful activities.
This AUP forms an integral part of CYBORA’s Terms & Conditions.
By using CYBORA services, you agree to comply with this AUP.
2. Scope
This AUP applies to all users, clients, partners, and any other parties accessing or using CYBORA services.
It covers all forms of use, including inbound and outbound communications, AI-driven interactions, APIs, and supporting systems.
The policy applies to both B2B and B2C use cases.
CYBORA reserves the right to enforce this AUP at its discretion.
3. Lawful and Authorized Use
Users must use CYBORA services only for lawful purposes and in compliance with applicable laws and regulations.
All instructions provided to CYBORA must be authorized and lawful.
Users must ensure they have the legal right to process and share any data used with the services.
Unauthorized or unlawful use is strictly prohibited.
4. Prohibited Activities
The following activities are strictly prohibited when using CYBORA services:
- use of services for illegal, fraudulent, deceptive, or misleading purposes;
- violation of data protection, privacy, telecommunications, or consumer protection laws;
- initiating outbound communications without valid consent or lawful basis where required;
- harassment, abuse, threats, or discriminatory conduct;
- impersonation or misrepresentation of identity or authority;
- interference with or disruption of CYBORA systems or networks.
5. Data Protection and Privacy Obligations
Users must comply with applicable data protection laws, including GDPR, UK GDPR, and relevant US privacy laws.
Personal data may only be processed in accordance with CYBORA’s Privacy Policy and Data Processing Agreement (DPA).
Users must not upload, transmit, or process special categories of personal data unless explicitly authorized and lawfully permitted.
CYBORA may suspend services if data protection violations are identified.
6. Outbound Communications and Marketing Use
Outbound communications must comply with applicable laws, including GDPR, UK PECR, and US TCPA.
Users are responsible for ensuring that valid consent or another lawful basis exists prior to initiating outbound marketing communications.
Suppression lists, opt-out requests, and do-not-call requirements must be respected.
CYBORA reserves the right to restrict outbound activities that present elevated compliance risk.
7. Use of Artificial Intelligence Systems
AI systems provided by CYBORA must be used in accordance with disclosed purposes and governance controls.
Users must not attempt to misuse, manipulate, or bypass AI safeguards.
AI systems must not be used for prohibited practices under the EU AI Act, including deceptive or exploitative use.
Human oversight requirements must be respected where applicable.
8. Security and System Integrity
Users must not attempt to compromise the security, integrity, or availability of CYBORA systems.
Prohibited actions include unauthorized access, penetration attempts, malware distribution, or denial-of-service activities.
Users must promptly report suspected security incidents or vulnerabilities.
CYBORA may investigate and take appropriate action in response to security risks.
9. Intellectual Property and Content
Users must respect CYBORA’s intellectual property rights and those of third parties.
Content provided through the services must not infringe copyrights, trademarks, or other proprietary rights.
Unauthorized copying, distribution, or modification of CYBORA materials is prohibited.
CYBORA reserves the right to remove infringing content.
10. Monitoring and Enforcement
CYBORA may monitor service usage to ensure compliance with this AUP, subject to applicable laws.
Violations may result in warnings, suspension, or termination of access to services.
Serious violations may be reported to relevant authorities.
CYBORA’s enforcement actions do not limit its other legal rights or remedies.
11. Consequences of Non-Compliance
Failure to comply with this AUP may result in immediate suspension or termination of services.
CYBORA is not liable for losses resulting from enforcement actions taken in response to violations.
Users may be held responsible for damages caused by misuse.
Contractual remedies under the Terms & Conditions remain unaffected.
12. Changes to This Policy
CYBORA may update this AUP from time to time.
Material changes will be communicated where required.
The updated version becomes effective upon publication.
Continued use of the services constitutes acceptance of the revised AUP.
