Pakalpojumu sniegšanas noteikumi
Last updated: [date]. These Terms govern your use of the CYBORA websites, the CYBORA platform, Experta, the Policy Templates Service, and any consultancy or vCISO/HybridSOC/GRC services we provide.
1. Contents of the websites
"The Websites" means cybora.tech (this public site), cybora.cloud (the client GRC and HybridSOC platform), audit.cybora.cloud (the free self-assessment portal) and any subdomain we operate, together with their content: marketing pages, the blog, the documentation wiki, the regulations wiki, the Policy Templates Service catalogue, the Trust Center, account areas, and the Experta AI assistant embedded across them.
We may add, remove, reorganise or update any part of the Websites' content at any time, including pricing, service descriptions, framework coverage and template catalogues, without prior notice. Where a specific engagement is governed by a separately signed agreement (a Master Services Agreement, order form or Statement of Work), that agreement prevails over these Terms for the matters it covers.
2. Use of the websites
You may use the Websites for their intended purpose: researching our services, managing your account, working inside the platform you're subscribed to, browsing or ordering policy templates, and communicating with our team or with Experta. You agree to provide accurate registration information, to keep your credentials confidential, and to notify us promptly of any suspected unauthorised use of your account.
You may not scrape, mirror or systematically extract content from the Websites; attempt to bypass access controls, rate limits or paywalls (including the price gate on the Policy Templates Service); upload malicious code; or use any part of the Websites to build a competing product or service. We may suspend or terminate access for conduct that violates this section, with or without notice depending on severity.
3. Confidentiality
Information you share with us that isn't public — self-assessment answers, GRC evidence, risk registers, Trust Center documents, or details submitted when registering a Policy Store account — is treated as confidential. We use it only to deliver the service you requested and do not disclose it to third parties except where necessary to operate the service (e.g. a sub-processor listed in our Privacy Policy), where you authorise it, or where the law compels it.
The same obligation runs the other way: any non-public methodology, pricing or product information we share with you should be treated as confidential and used only for evaluating or using our services. This obligation survives the closure of your account or the end of an engagement for a reasonable period.
4. Copyright and other intellectual property rights
Everything that makes up the Websites — code, design, the CYBORA name and logo, the wording of our documentation and regulations wiki, and every policy template before it is purchased — is the intellectual property of CYBORA, UAB (or its licensors) and is protected under Lithuanian and applicable EU and international copyright and trademark law.
Browsing the Websites grants you no rights beyond viewing the content for your own evaluation. You may not reproduce, republish, mirror or redistribute any part of the Websites, including screenshots of the Policy Templates Service preview pages, without our prior written permission. Buying a policy template does not transfer copyright to you — it grants the specific usage licence described in the Policy Templates Service terms below (Section 8).
5. Disclaimer and limitation of liability
The Websites, the platform, Experta's output and every policy template are provided "as is" and "as available". We do not warrant that the Websites will be uninterrupted, error-free, or free of harmful components, and nothing on the Websites — including framework mappings, regulations wiki explanations or Experta's answers — constitutes legal, regulatory, financial or security advice for your specific situation.
To the maximum extent permitted by applicable law, CYBORA's total liability arising out of or in connection with your use of the Websites or a paid engagement is limited to the amount you paid us, in EUR, for the specific service giving rise to the claim during the 12 months preceding the event. Neither party is liable for indirect, incidental, special or consequential damages, including lost profits or lost data, even if advised of the possibility.
6. Privacy policy
Our Privacy Policy explains what personal data we collect across the Websites (account and billing details, self-assessment answers, cookies and analytics, chat transcripts with Experta), why we collect it, how long we keep it, and the rights you have under the GDPR — including access, correction, erasure and portability. It forms part of these Terms by reference.
You can read the full Privacy Policy at any time from the footer of any page, and reach our privacy contact at info@cybora.tech for any data-protection request.
7. Terms of use for Experta
Experta is CYBORA's AI-assisted compliance and support assistant, available as the chat widget on cybora.tech and inside the platform. Experta answers questions using a curated knowledge base — our services, the regulations wiki, and the Policy Templates Service catalogue — and, depending on your plan, may draft suggested text for review.
Experta's answers are generated automatically and may be incomplete, out of date, or simply wrong; they are never a substitute for advice from a qualified professional and must be reviewed by a person before you rely on them. Conversations may be logged and reviewed by our team to improve accuracy and to follow up on unanswered questions, subject to the Privacy Policy. Do not submit information through Experta that you would not want processed under those terms, and do not attempt to use Experta to extract another client's data, probe the underlying model, or automate bulk querying — we may rate-limit or suspend access to prevent abuse.
8. Terms of use for documentation templates
The Policy Templates Service (/policies) offers professionally drafted policy documents mapped to frameworks such as ISO 27001, SOC 2, DORA, NIS2, GDPR, MiCA and the EU AI Act. The underlying files are never linked or downloadable before purchase — only the title, a description and a short preview are shown, and prices are shown only to a signed-in Policy Store account.
Purchasing a template grants a perpetual, non-exclusive, non-transferable licence to adapt and use it internally within the company (or companies) named on the order — under a single-company, company-group, or multi-company licence as selected at checkout, each priced as described on the ordering page. It is not a sale of copyright: reselling, redistributing, publishing, or offering the templates (original or adapted) to third parties as a standalone deliverable is prohibited. Templates are drafting aids, not legal advice — have them reviewed by your compliance owner or counsel before adoption.
9. Purchasing, subscription and free trials
Platform subscriptions (cybora.cloud) are billed periodically in EUR as set out in your order form, renew automatically unless cancelled before the next billing date, and are subject to VAT and any applicable local taxes in addition to the listed price. audit.cybora.cloud offers a free self-assessment with no payment details required, which you may use to evaluate the platform before subscribing.
Policy Templates Service orders are one-off purchases: placing an order generates a unique order code and bank-transfer instructions (recipient, IBAN, SWIFT/BIC); the order is confirmed once payment referencing that code is received, and templates are delivered by e-mail within one business day of confirmation. Consultancy engagements (vCISO, HybridSOC onboarding, compliance advisory) are invoiced according to the applicable proposal or order form, generally payable within 14 days of issue.
10. Availability, errors and inaccuracies
We aim to keep the Websites and the platform available at all times and publish live status at /status, but scheduled maintenance, third-party outages, or events outside our reasonable control may interrupt access. We will give notice of planned maintenance where practical.
Prices, descriptions, framework mappings and other content on the Websites may occasionally contain typographical errors or be out of date. Where a policy template or service is listed at an incorrect price, we will contact you before processing an affected order to confirm the correct price or to cancel it, and reserve the right to correct any error at any time, even after an order has been submitted but not yet paid.
11. Refund & cancellation policy
Platform subscriptions may be cancelled at any time from your account; cancellation takes effect at the end of the current billing period, and we do not provide partial refunds for unused time except where required by law. The free self-assessment on audit.cybora.cloud carries no charge, so no refund applies.
Because policy templates are delivered as digital files immediately usable on receipt, orders are non-refundable once the templates have been delivered — except where a template is materially defective (corrupted file, or substantially misdescribed relative to its published description). Refund requests on that basis must be sent to info@cybora.tech within 14 days of delivery, quoting the order code. Consultancy engagements follow the cancellation terms of the applicable order form.
12. Governing law
Where services are contracted with CYBORA, UAB, these Terms are governed by the laws of the Republic of Lithuania, and any dispute not resolved amicably falls under the exclusive jurisdiction of the Lithuanian courts. Where a US engagement is contracted with a CYBORA US entity, the applicable order form will identify the governing state law; in the absence of such a designation, Lithuanian law applies.
These Terms, together with any order form, Statement of Work or policy referenced here (including the Privacy Policy and the Policy Templates Service licence terms), form the entire agreement between you and CYBORA regarding the Websites. We may update these Terms from time to time; material changes will be notified to active clients, and continued use of the Websites after changes take effect constitutes acceptance.
